General terms and conditions
At Forivita, we apply clear and transparent general terms and conditions to all our services and products. Here, you will find information about our working methods, responsibilities, and your rights as a consumer. Our terms comply with applicable laws and regulations.
Article 1 – Definitions
In these general terms and conditions, the following definitions apply:
Entrepreneur: Forivita
Consumer: the natural person who is not acting in the exercise of a profession or business
Product: all products offered via the webshop
Agreement: the purchase agreement concluded via the webshop
Webshop: the entrepreneur's online store
Article 2 – Applicability
These general terms and conditions apply to every offer and to every distance contract between the entrepreneur and the consumer.
By placing an order, the consumer declares to agree with these terms.
Article 3 – The offer
The products are described as fully and accurately as possible.
Images are for illustration purposes and may deviate slightly from the actual product.
Obvious mistakes or errors in the offer are not binding on the entrepreneur.
Article 4 – The agreement
The agreement is concluded at the moment the consumer completes the order and payment has been made.
After placing an order, the consumer will receive a confirmation by e-mail.
Article 5 – Prices
All prices are stated in euros and include VAT.
Any shipping costs will be clearly stated before the order is completed.
The entrepreneur reserves the right to change prices.
Article 6 – Payment
Payment is made via the offered payment methods.
The entrepreneur is entitled to refuse an order if payment has not been received.
Article 7 – Delivery
Orders will be delivered as soon as possible, within 30 days at the latest.
Delivery takes place in the Netherlands and Belgium.
If delivery is delayed, the consumer will be informed in a timely manner.
The risk of damage or loss lies with the entrepreneur until the moment of delivery.
Article 8 – Right of withdrawal
The consumer has the right to withdraw from the agreement within 14 days after receipt, unless the product is excluded on the basis of article 9.
The withdrawal period starts on the day after receipt of the product.
Article 9 – Exclusion of right of withdrawal (hygienic product)
The right of withdrawal is excluded for hygienic products whose seal or packaging has been opened.
Personalized or custom-made products
If the packaging has been opened or the product has been used, the product cannot be returned.
Article 10 – Returns and refunds
Returns must be registered within 14 days after withdrawal.
The product must be returned unused, undamaged, and in its original, unopened packaging.
After correct receipt, the purchase amount will be refunded within 14 days.
Return costs are for the consumer's account, unless stated otherwise.
Article 11 – Use and liability
The products must be used according to the enclosed instructions.
The entrepreneur is not liable for damage caused by incorrect or improper use.
Liability is in all cases limited to the amount of the order.
Article 12 – Warranty and conformity
The entrepreneur guarantees that the product complies with the agreement and reasonable expectations.
Complaints about defects must be reported within a reasonable period after discovery.
Article 13 – Complaints procedure
Complaints can be submitted via info@forivita.nl.
The entrepreneur will respond substantively within 14 days.
Article 14 – Force majeure
In case of force majeure, the entrepreneur is entitled to suspend obligations or dissolve the agreement.
Article 15 – Intellectual property
All intellectual property rights relating to the webshop, texts, images, and products belong to the entrepreneur.
Article 16 – Applicable law
Dutch law applies to all agreements.
Article 17 – Disputes
Disputes will be submitted to the competent court in the Netherlands, unless mandatory law stipulates otherwise for Belgian consumers.
Article 18 – Product use, Safety and Disclaimer
1. Applicability of Disclaimer Our comprehensive Disclaimer also applies to the purchase and use of the products supplied by the entrepreneur (including the Essential Oil Bracelets). This can be consulted via Disclaimer.
2. No medical guarantees or protection Our products use natural essential oils and expressly do not offer guaranteed protection against insect-borne diseases. The product is not a medical preventive measure. When traveling to high-risk areas, the consumer must always follow the advice of health authorities (such as the GGD).
3. Allergies and own risk The bracelets and any refills contain highly concentrated essential oils. Although natural, contact with these oils or their vapors can lead to allergic reactions or skin irritation in some individuals. The use of the product is entirely at the consumer's own risk. If any form of irritation occurs, use should be stopped immediately.
4. Safety and vulnerable groups The products are intended for external use only. Due to the risk of choking (due to small parts) and extra sensitive skin, the bracelets are not suitable for and must at all times be kept out of reach of children younger than 3 years. Pregnant women and people with conditions such as asthma or epilepsy should consult a doctor before use.
5. Exclusion of liability The entrepreneur is never liable for any form of direct or indirect damage arising from or related to the (improper) use of the supplied products. This explicitly includes, but is not limited to: physical injury, allergic reactions, infections, or insect bites/stings.
